What is so difficult to understand about this dual phased order? It is the stubborn refusal of the Chairperson to observe her own order that has brought the most recent imbroglio of this electoral process. Her unfounded obduracy or crass dissembling pushed the Government to seek judicial review which the Court of Appeal has ruled that all votes found in a ballot box are not valid.
The votes are only valid if they confirm to the qualitative criteria adumbrated in the Gazzetted Order. Anyone who champions the view that a declaration must be made against tabulated votes or votes that have been stuffed into a ballot box is a crook and my language is for a family audience.
The matter of a declaration against fraudulent tabulated votes and the loser approaching the courts through an election petition is off the table for the Coalition. The Chairperson was able to inveigle the Courts to permit Gecom to enter into the ballot boxes before a declaration. To be granted that permission was historic. The Chairperson was not enamored by the revelations arising out the entry into the ballot boxes. The Chairperson cannot at this stage refuse to use the evidence unearthed to make a declaration. Succinctly put, the Gazzetted Order was in fact the Elections Petition, she has to live or die on her Order.
